Charitable employer
A long standing employee of 21 years had been seconded to associated organisation. At the end of the secondment the original job no longer existed and she was offered alternative employment which she refused. She was consequently dismissed for gross misconduct.
The employee was convinced that it was in reality a redundancy situation and there was a great deal of hurt for the employee to be dismissed on that basis.
The new Director of the charity was able to acknowledge this pain and hurt without in any way compromising his position. This understanding by the new Director of the hurt the employee had experienced and the consequences on her health of what had happened coupled with an indication of a willingness to change records to reflect a redundancy situation allowed the matter to be resolved.
