Insurance claim


The claimant’s wife sustained a brain aneurysm whilst on holiday. Both travel and medical care insurance were in place and they received notification of cover to allow treatment which was later withdrawn. 

A planned operation was cancelled and the wife died a few weeks later after being repatriated. The claimant was pursuing more as a matter of principle than for any other reason. There were issues over liability, causation and quantification of the claim (especially whether there was any entitlement to claim consequential loss) and also issues amongst the different insurers on indemnity.

The various insurers were able to meet together and discuss the way forward and appropriate tactics, against the background that all parties had already spent considerable sums to get to this point. An overall settlement package, with contributions from various insurers, was agreed at the end of the day.
