Civil Justice Reform in Scotland
John Sturrock recently addressed two conferences on mediation and civil justice.
In the speech, entitled 'The Role of Mediation in a Modern Civil Justice System' he argues that we are moving into a new era. Just as we moved from dispute resolution based on trial by combat to dispute resolution based on trial by jury or determination by a judge, there is a shift towards a post-litigation culture around the world where people seek and will find different ways of dealing with disputes.
He discussed the place of mediation as one of a range of methods of differences in this post-litigation culture.
