We
have now completed our work on the User’s Guide to Mediation in Planning.
Carried out in association with the Scottish Government, the Guide will be launched
at a special event this month at which the Cabinet Secretary for Finance and
Sustainable Growth, John Swinney MSP, will be the key speaker. Our work
in the preparation of the guide and the accompanying report to the Scottish
Government has revealed the extensive possibilities for the use of
mediation in planning from the pre-development stage right through to
appeals.
What
is needed now are some real examples of mediation in planning in Scotland on
which to build experience and confidence in a process which can be a real asset
to a more creative and cost effective approach to the use and development of
land in Scotland.
As
part of our initiative to use mediation in some of the bigger issues facing our
society, Core is promoting a special event:
The Challenge of
Climate Change: Wind, Water, Fossil or Fission?

When this workshop was held
at the ABA conference in New York in 2004, the topic selected was “Dealing
with Terrorists”. At an International Trade Mark Association meeting in
Berlin and at the European Mediation Conference in Belfast last year, those
participating in a similar session chose “Global Warming and Climate Change”.
John Sturrock will again facilitate this session at the forthcoming ABA
conference on dispute resolution in New York in April.
Michael
addressed two meetings during his February visit. The first of these was
an invited group of specialists in the field of intellectual property.

A
key conclusion was that inserting mediation clauses into contracts would
require people to consider engaging in mediation and help to overcome any fear
of appearing weak by suggesting mediation. Click here to
refer to Core’s example mediation clause.
Michael
also addressed a group of approximately 30 lawyers and other advisers on the
theme of Global Trends in Dispute Resolution. He pointed out that
the world is changing rapidly and that the characteristics of leadership might
now be redefined to include: responsibility, transparency, authenticity,
trustworthiness, certainty, competency, sustainability and frugality.
Michael
Leathes is joined by several other in-house counsel in
a provocative article about the future of the provision of legal services
entitled, ‘A Perfect Storm’. Click here to

Core
has recently refined its services in light of the significant changes occurring
as a result of the economic downturn and new legislation. In recent
years, Core has been involved as mediator or facilitator in a significant
number of workplace disputes and other differences involving senior employees,
executives and teams within organisations.
There
are inevitably increasing tensions as people face up to the impact of a recession,
and scope for high quality independent mediation and facilitation, together
with excellent training, has never been greater. Click here to

Core
and the Agricultural Law Association co-hosted an event at Stirling Management
Centre in February on the topic of ‘Mediation in Agricultural Disputes’.
Sir Crispin Agnew of Lochnaw Bt QC and Jamie Whittle of R & R Urquhart and
a Core Associate set out the range of areas in which mediation can be used to
enhance the management and resolution of disputes in an agricultural
context. The large attendance of land agents, surveyors, lawyers and
others with an interest in agriculture witnessed a demonstration of mediation
in practice, conducted by John Sturrock, involving a landlord and a tenant
farmer with their respective advisors. Suffice to say that many in the
audience thought that the example was very real to life! There was an
enthusiastic response and many left thinking that there is much scope for the
use of mediation in this field.
Ken
Cloke, our guest in December, has launched a petition calling on President
Obama and his new administration to actively promote the use of conflict resolution in
all his efforts to bring about change and to address the urgent economic,
environmental, and health care crises we presently face. Click here to

We are deeply indebted to Anna
Doyle, Head of Mediation Service
at
Eurocontrol in Brussels and a participant in our
December Master Class for this excellent summary of what Ken shared with us,
entitled A Lesson in Flight (…experiencing a master class

The
Scottish Mediation Network, in collaboration with Dundee University Press, is
launching a new book on mediation this month.
Mediation
is developing in many different areas today throughout Scotland. While some of
these may be familiar, others are less well known. For the first time, these
areas are comprehensively brought together in A Guide to Mediating in
Scotland. As well as exploring the differences which occur between
these developments, the book also identifies the key skills and core values in
each and explores the common themes. This book will be invaluable to anyone
either thinking of how mediation may assist or simply wanting to know more.
