Judging Alternatives to Courts
The courts of law are one of a range of methods of dispute resolution in a modern society – one which usually should serve as a very effective last resort. That proposition seems to be accepted by many people in many jurisdictions (including our own). However, it appears to some that the recent review of civil courts has taken a rather different view, in its conclusion that access to the courts is a fundamental right.
John Sturrock considers the role of litigation, and the courts, in resolving disputes in his article 'Judging Alternatives to Courts', published in the Scotsman on 28th June 2010.
The article follows on from John Sturrock's recent presentations to two conferences on mediation and civil justice, the amalgamated text of which was published as an article, entitled 'The Role of Mediation in a Modern Civil Justice System' in the Scots Law Times on 25th June 2010.
