Mediation in the Banking World
In March John Sturrock and Sandy Wilson led a well attended event hosted by the Chartered Institute of Bankers in Scotland at which they explored the way in which banks have been using mediation in a variety of situations including:
- debt recovery and insolvency of customers
- professional negligence against advisers
- issues with tax authorities, allegations of fraud
- customer allegations and complaints
- employment, management and workplace.
Sandy Wilson outlined the many advantages which he, as a former senior banker, had experienced in using mediation:
- Mediation almost always adds value
- Resolution and CLOSURE were achieved in a high percentage of cases
- Provides a valuable opportunity to meet with, speak to and LISTEN to the other side
- Gives a better UNDERSTANDING of where other side is coming from – and what they see as SUCCESS
- Always possible to receive new information – thus, the need for an open mind
- Participants retain CONTROL during the flexible process
- Confidential, without prejudice and cost-effective
